Mended Mind Therapy LLC ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information when you visit our website and, if you become a client, when you receive clinical services from us.

This policy governs our website and general digital interactions. If you are a current or prospective client, our Notice of Privacy Practices ("NPP") (available on this Site and provided to you at intake) governs how we handle your Protected Health Information ("PHI") as required by the Health Insurance Portability and Accountability Act ("HIPAA").

By using this Site, you agree to the practices described in this Privacy Policy.

2. Who This Policy Covers

This Privacy Policy applies to:

     •  Visitors to our website (the "Site")

     •  Individuals who contact us through the Site or via email

     •  Current and prospective clients, in conjunction with our Notice of Privacy Practices

3. Information We Collect

From Website Visitors

When you browse our Site, Squarespace -our website platform- automatically collects certain technical information, including:

     •  IP address and approximate geographic location

     •  Browser type, version, and operating system

     •  Pages visited, time spent on each page, and referring URL

     •  Device type

This information is used to operate, maintain, and improve the Site. It is not linked to your identity unless you choose to contact us.

From Individuals Who Contact Us

If you reach out through our contact form or email, we may collect your name, email address, and any information you voluntarily include in your message. We use this information solely to respond to your inquiry.

If you choose to schedule a consultation or appointment through the “Work With Me” button, Sessions Health will collect your name, date of birth, phone number, email address, and any other information you voluntarily include in your scheduling request. We use this information solely to respond to your request, schedule your appointment, to prepare intake forms/paperwork, and to set up a client account on Sessions Health. 

Important: Please do not submit sensitive personal or health information through our general website contact form or standard email. These channels are not HIPAA-secure. To securely share health information, please use the client portal provided through Sessions Health.

From Clients

If you become a client of Mended Mind Therapy LLC, we collect health, demographic, and insurance information necessary to provide clinical services and process claims. This information is governed by our Notice of Privacy Practices, which you will receive at intake and which is also available on this Site.

4. How We Use Your Information

We use the information we collect to:

     •  Operate and improve our website

     •  Respond to inquiries and schedule consultations

     •  Provide mental health services to clients

     •  To collect payment/process insurance billing, including with Optum, Cigna, Aetna, and other credentialed insurers

     •  Meet our legal and professional obligations as a Licensed Clinical Social Worker (LCSW) in Wisconsin and Florida

     •  Communicate with you about your care

We do not sell, rent, or trade your personal information to third parties for marketing purposes.

5. Third-Party Services

We use the following third-party platforms to operate our practice. Each has its own privacy policy, which we encourage you to review.

Squarespace

Our website is hosted and built on Squarespace, Inc. Squarespace automatically collects technical data from site visitors (as described in Section 3) to operate and provide analytics for the Site. Squarespace is not a HIPAA Business Associate, and no protected health information should be submitted through general site forms.

Sessions Health

We use Sessions Health, a HIPAA-compliant electronic health record (EHR) and practice management platform, for scheduling, clinical documentation, secure client messaging, and billing. Sessions Health has entered into a Business Associate Agreement (BAA) with Mended Mind Therapy LLC as required by HIPAA. Any health or personal information you submit through the Sessions Health client portal is protected under our HIPAA policies and agreements.

Google Workspace

We use Google Workspace (provided by Google LLC) for internal purposes including practice email, drafting auxiliary clinical documentation (such as accommodation letters and emotional support animal letters), and administrative record-keeping. Google has entered into a Business Associate Agreement (BAA) with Mended Mind Therapy LLC, and our use of Google Workspace is limited to our business account covered under that agreement.

Please note that standard email is not a fully encrypted, end-to-end secure communication channel. We ask that clients not send sensitive health information via email. For secure communication, please use the client portal provided through Sessions Health.

6. Cookies and Tracking Technologies

Our website uses cookies (small data files stored on your device) to support website functionality and analytics through Squarespace. These cookies help us understand how visitors interact with the site so we can improve it.

You may adjust your browser settings to decline or delete cookies. Doing so will not affect your ability to browse the Site, though some features may function differently. We do not use cookies to collect protected health information.

7. HIPAA and Protected Health Information

Mended Mind Therapy LLC is a HIPAA-covered entity. We maintain policies and procedures designed to protect the privacy and security of your Protected Health Information in accordance with the HIPAA Privacy Rule (45 C.F.R. Parts 160 and 164).

Our Notice of Privacy Practices provides a detailed explanation of:

     •  How we may use and disclose your health information

     •  Your rights to access, amend, restrict use of, and receive an accounting of disclosures of your information

     •  How to file a complaint if you believe your privacy rights have been violated

The Notice of Privacy Practices is provided to all clients at intake and is available upon request by contacting us at the email address in Section 15.

8. Telehealth Services

Mended Mind Therapy LLC provides services exclusively via telehealth. Our clinician is licensed to practice in Wisconsin and Florida. By engaging in services, you acknowledge that you are physically located in the state of Wisconsin or Florida at the time of each session. Telehealth sessions are conducted using HIPAA-compliant technology with appropriate safeguards in place.

9. Data Security

We take reasonable administrative, technical, and physical safeguards to protect the information we collect and maintain. Our website is encrypted via SSL/TLS (HTTPS). Clinical and health information is stored within Sessions Health's HIPAA-compliant, encrypted infrastructure.

No method of electronic transmission or storage is completely secure. While we are committed to using industry-standard protections, we cannot guarantee absolute security. In the event of a breach affecting your PHI, we will notify you as required by the HIPAA Breach Notification Rule (45 C.F.R. Part 164, Subpart D).

10. Children's Privacy

Our services are intended for adults. We do not knowingly collect personal information from individuals under the age of 18 without verifiable parental or guardian consent. If you believe a minor has submitted personal information through our Site without appropriate consent, please contact us using the information in Section 15 and we will promptly take steps to remove it.

11. Data Retention

We retain client records in accordance with applicable professional licensing requirements and state law. Wisconsin and Florida both require mental health records to be retained for a minimum of seven (7) years from the date of last service, or for clients who were minors at the time of treatment-seven (7) years after the client reaches the age of majority. Website visitor data collected through Squarespace is subject to Squarespace's own data retention policies.

12. Your Privacy Rights

As a Client/HIPAA Rights

As a current or former client, you have the right to access, amend, restrict the use of, and receive an accounting of disclosures of your Protected Health Information, as described in full in our Notice of Privacy Practices.

Wisconsin and Florida Residents

While neither Wisconsin nor Florida has currently enacted a comprehensive consumer privacy law, you may contact us with any questions or requests regarding your personal information and we will respond in good faith.

Opting Out of Non-Clinical Communications

You may opt out of receiving non-clinical communications at any time by contacting us at the email address in Section 15.

13. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. When we do, we will revise the "Last Updated" date at the top of this page. We encourage you to review this policy periodically. Your continued use of the Site after any changes are posted constitutes your acceptance of the updated policy.

14. Not an Emergency Service

Mended Mind Therapy LLC is not a crisis or emergency service. If you or someone you know is experiencing a mental health emergency, please call 911 or contact the 988 Suicide & Crisis Lifeline by calling or texting 988. You may also go to your nearest emergency room.
